Purified News Terms Of Service

1. You and Purified News

Welcome to Purified News (the “Platform”),  provided by Purified News Inc. in Vancouver,  British Columbia,  Canada (collectively such entities will be referred to as “Purified News”, “we” or “us”).

You are reading the terms of service (the “Terms”), which govern our relationship (You and Purified News) and serve as an agreement between you and us, outlining the terms and conditions pursuant to which  you may access and use the Platform and our related websites, applications, services, content, products (collectively, the “Services”).   Certain Services or features of the Services (such as the ability to upload or share User Content (defined below)) may be restricted to users of a certain age and not available to all users of the Services. Our Services are provided for personal, non-commercial us. In these terms of service “you” and “your” refers to you as the user of the Services.

Between you and us the Terms form a legally binding agreement. Please take the time to carefully read them. If you are less than 19 years old, you may only use the Services with the permission of your parent or legal guardian. Please ensure that you have your   parent or legal guardian’s consent and ask them to   review and discuss these Terms with you.

ARBITRATION NOTICE. Any disputes between you and Purified News will be resolved by Mandatory Binding Arbitration and you and Purified News waive any right to participate in a law suit of any kind including a class action lawsuit or class- wide arbitration.

2. Acceptance of Our Terms of Use

By accessing or using our Services, you affirm you are of legal age and as such can be bound by these terms, and can form a binding contract with Purified News, and that you accept these Terms and that you agree to comply with them. Your access to and use of our Services is also subject to our Privacy Policy and Community Guidelines, which can be found directly on the Platform,  or  on your mobile device’s applicable app store.. By using the Services, you agree to the terms of the Privacy Policy and Community Guidelines.

If your  access or use of  the Services is on behalf of a business or entity, then (a) “you” and “your” includes you and that business or entity, (b) you warrant and represent  that you have the unrestricted authority of that business or entity to bind same to these terms, and that you accept these terms on that business or entity’s behalf  and (c) your business or entity  vicariously  responsible for your access or use of the Services and  for the access or use of your account by others affiliated with your entity, including any employee’s, agents or contractors.

From the moment you access or use our Services you agree to   accept Our Terms of Use   

3. We Can Change these Terms

When we change or improve the functionality of our Services, when we combine numerous apps or services run by us or our affiliates into a single service or app, or when regulatory changes occur, we may change these Terms.. We will adhere to commercial reasonableness and principles of   and good faith  to  and make best efforts to  notify all users of any significant  changes to these Terms, such aa by posting  a notice on our Platform, however, you should review the Terms regularly to check for such changes. We will also update the “Last Updated” date at the top of these Terms, which reflect the effective date of such Terms. If you continue to access or use of the Services after the date of the new Terms you thereby accept the new Terms. You must stop accessing or using the Services if you do not agree to the new Terms,.

4. Your Account with Purified News

To access or use some of our Services, you must create an account with us. When you create this account, you must provide accurate and up-to-date information. It is important that you maintain and promptly update your details and any other information you provide to us, to keep such information current and complete.

It is important that you keep your account password secure and that you do not reveal it to anyone.. If you know or think that anyone knows your password or has accessed your account, you must tell us immediately at: contact@purified.news.

You agree that you are exclusively responsible (to us and to others) for the activity and behavior that occurs under your account.

You agree we can disable your account at any time, for any reason, including if you have failed to comply with any of the provisions of these Terms, or if activities occur on your account which, in our sole discretion, would cause damage to the Services or infringe or violate any third party rights, or violate any applicable laws or regulations.

If you no longer want to use our Services again, and would like your account deleted, contact us at: contact@purified.news. We will provide you with further assistance and guide you through the process. In the event we cancel your account, you will not be able to reactivate your account or recover any of the information or content you have added.

5. Your Access and Use of Our Services

Your access to and use of the Services is subject to these Terms and all applicable laws and regulations. You may not:

• access or use the Services if you are not fully able and legally competent to agree to these Terms or are authorized to use the Services by your parent or legal guardian;
• make, copy, adapt, change, translate, dissemble, reverse engineer, or decompile  any content, including any tables, files, documentation, images, or create any derivative works of the Services;
• ascertain, determine, or attempt  to ascertain or determine any source code, methods, algorithms, techniques, files, tables or documentation (or any portion thereof) embodied by the Services or any derivative works thereof;
• license, distribute, convey,  or sell, in whole or in part, any of the Services or any derivative works thereof;
• monetize, market, rent or lease the Services for a fee or for any charge, or use the Services to  perform any commercial solicitation;
• use the Services, without our express written consent, for any commercial or unauthorized purpose, including communicating or facilitating any commercial advertisement or solicitation or spamming;
• interfere with or attempt to interfere with the proper working of the Services, disrupt our website  or App or any network connected to the Services, or circumvent or bypass  any steps we take to prevent or restrict access to the Services;
• incorporate  the Services or any portion thereof into any other program or product. In such cases, we reserve the right, in our sole discretion, to refuse service, terminate accounts or restrict  access to the Services 
• employ  automated scripts to collect data or information of any kind  from the Services  or  interact with the Services in any other way;
• falsely declare or otherwise misrepresent you or your affiliation with any person or entity, including providing the idea that any content you upload, post, transmit, distribute, or otherwise make available comes from the Services
• intimidate or harass another person , or promote sexually explicit content , violence or discrimination based on race, gender, gender identification, religion, nationality, disability, sexual orientation or age;
• use or attempt to use another user’s  account, service or system without authorization from Purified News, or create a false identity on the Services;
• use the Services in a way  that could result in a conflict of interest or undermine the goals  of the Services, such publishing  or soliciting fake or fraudulent  reviews;
• use the Services to upload, transmit, distribute, store or otherwise make available in any way: files that contain viruses, trojans, worms, logic bombs or infections of any kind, or  other material that is malicious or technologically harmful;
• use the Services to proliferate or promote unsolicited or unauthorized advertising, “chain letters solicitations, promotional materials, “junk mail,” “spam,”,” “pyramid schemes,” or any other prohibited form of solicitation;
• use the Services to disclose any private information of any third party, including addresses, phone numbers, email addresses, information contained in any personal identity documents (e.g., National or Social Insurance numbers, passport numbers, Nexus cars, driver licenses) or credit card numbers;
• use the Services to distribute any material which may or does infringe any copyright, trademark or other intellectual property or privacy rights of any other person;
• use the services to create or share any material (not referenced within links) which is defamatory of any person, obscene, offensive, pornographic, hateful or inflammatory;
• use the Services to create or share any material that would constitute, encourage or provide instructions for a criminal offence, dangerous activities or self-harm;
• use the Services to create or share any material that is deliberately designed to provoke or antagonize people, especially trolling and bullying, or is intended to harass, harm, hurt, scare, distress, embarrass or upset people;
• use the Services to create or share any material that contains a threat of any kind, including threats of physical violence;
• use the Services to create or share any material that is racist or discriminatory, including discrimination on the basis of someone’s race, religion, age, gender, gender identification, disability or sexuality;
• use the Services to create or share any answers, responses, comments, opinions, analysis or recommendations that you are not properly licensed, accredited, or otherwise qualified to provide; or
• use the Services to create or share material that, in the sole judgment of Purified News, is objectionable , restricts or inhibits any other person from using the Services, or may expose Purified News, the Services or its users to any harm or liability of any variety 
• In addition to the above, your access to and use of the Services must, at all times, be compliant with our Community Guidelines.

We reserve the right, at our sole discretion, at any time and without notice, to remove or disable access to our Services   for any reason or no reason. For example, we may remove or disable access to content we find objectionable, in violation of how to purify news or these Terms or our Community Policy, or otherwise harmful to the Services or our users. We strive not to editorialize, secure in the knowledge that our  automated systems analyzes your content (reports that you create) to provide you with important changes that are needed, personally relevant product features, such as customized search results, tailored advertising, and spam and malware detection. This analysis occurs as the content is sent, received, and when it is stored. However, we reserve the right to intercede in any behavior harmful to our goals.

6. IP (Intellectual Property) Rights

We respect IP rights and ask you to do the same. As a condition of your access to and use of the Services, you confirm to agree to our Copyright policy set out below. 

7. Content

Purified News Content

As between you and Purified News, all content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and “look and feel” of the Services, and all intellectual property rights related thereto (the “Purified News Content”), are either owned or licensed by Purified News, it being understood that you will own any User Content (as defined below) you upload or transmit through the Services. Use of the Purified News Content or materials on the Services for any purpose not expressly permitted by these Terms is strictly prohibited. Such content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever without our or, where applicable, our licensors’ prior written consent. We and our licensors reserve all rights not expressly granted in and to their content.

You acknowledge and agree that we may generate revenues, increase goodwill or otherwise increase our value from your use of the Services, including, by way of example , through the sale of advertising, sponsorships, promotions, usage data, and membership,  and Gifts (defined below), and except as specifically permitted by us in these Terms or in another agreement you enter into with us, you will have no right to share in any such revenue, goodwill or value whatsoever. You further acknowledge that, except as specifically permitted by us in these Terms or in another agreement you enter into with us, you (i) have no right to receive any income or other consideration from any User Content (defined below) or your use of any text, sound recordings or audiovisual clips made available by you on or through the Services, including in any User Content created by you, and (ii) are prohibited from exercising any rights to monetize or obtain consideration from any User Content within the Services or on any third party service ( e.g. , you cannot claim User Content that has been uploaded to a social media platform such as YouTube for monetization).

Subject to the terms and conditions of the Terms, you are hereby granted a limited, non-transferable, non-exclusive, non-transferable, revocable, non-sublicensable worldwide license to access and use the Services/ This includes a license to download the Platform on a permitted device, and to access the Purified News Content solely for your personal, non-commercial use through your use of the Services and solely in compliance with these Terms. Purified News reserves all rights not expressly granted herein in the Services and the Purified News Content. You acknowledge and agree that Purified News may terminate this license at any time for any reason or no reason.

 SOUND RECORDINGS AND THE MUSICAL WORKS EMBODIED THEREIN THAT ARE MADE AVAILABLE FROM OR THROUGH THE SERVICE ARE NOT LICENSED.

You acknowledge and agree that when you view content provided by others on the Services, you do so at your own risk. The content on our Services is provided for general information only. It is not advice on which you should rely, and you are encouraged to seek the advice of a professional or specialist before acting or not acting on the basis of the content on our Services.

We endeavor to provide verified News but we cannot make representations, warranties or guarantees, whether express or implied, that any Purified News Content (including User Content) is accurate, complete or up to date We ourselves rely on what appears to be known.. Where our Services contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no ownership or control over the contents of those sites or resources. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. You acknowledge that we have no obligation to pre-screen, monitor, review, or edit any content posted by you and other users on the Services (including User Content).

User-Generated Content

Users of the Services are  permitted to upload, post or transmit  or  make available content through the Services including, without limiting the generality of the foregoing,  any text, backgrounds including sound, people, images, company names and logos, and others (“User Content”). Users of the Services may include collaborative User Content with other users in order to generate Content by more than one user. Users of the Services may be provided with overlay graphics, bullet points, media links, virtual Items and other elements provided by Purified News (“Purified News Elements”) and transmit this User Content through the Services. The information and materials in the User Content, including User Content that includes Purified News Elements, have not been verified or approved by us. The views expressed by other users on the Services  do not represent our views or values.

Whenever you access or use a feature that allows you to upload or transmit User Content through the Services (including via certain third party social media platforms such as Instagram, Facebook, YouTube, Twitter), or to make contact with other users of the Services, you must comply with the standards set out above. You may also choose to upload or transmit your User Content, including User Content that includes Purified News Elements, on sites or platforms hosted by third parties. If you decide to do this, you must comply with their content guidelines as well as with the standards set out above. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any User Content will be considered non-confidential and non-proprietary. You must not use our Services to post any User Content that you consider to be confidential or proprietary. When you submit User Content through the Services, you agree and represent that you own the rights to use Content including content within video and or audio recordings, or in the alternative you have received permission, licenses, power/authority to submit it to the Services, and   to transmit it from the Services to other third party platforms, and/or adopt any third party content.

You or the owner of your User Content still own the copyright in User Content sent to us, and you retain the rights to any content you submit, but by submitting, displaying or posting content  through  the Services, you  grant us a worldwide, non-exclusive, royalty -free license, to use, copy, reproduce, process, publish, modify, adapt, display or distribute  the content in any and all methods now known or later developed (including curating, translating and transforming) This license allows us and others to make your content available to the rest of the world and to let other users of the Services and other third-parties  view, publish, use in any way  and/or transmit your User Content

You further grant us a royalty-free license to use your user name, image, voice, and likeness to identify you as the source of any of your User Content; however, owing to age limits, your ability to submit an image, voice and /or likeness may be limited.

Through-To-The-Audience Rights.  Rights 

All of the rights you grant in your User Content under these are provided on a through-to-the-audience basis, which means that the owners or operators of third party services will have no separate liability to you or any other third party for User Content posted or used on such third party service via the Services.

Waiver of Rights to User Content

You renounce all rights to prior review or approval of any marketing or promotional materials relating to User Content by posting it to or through the Services. In connection with your User Content you also renounce any and all rights to privacy, publicity of similar rights. You also waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection with your User Content, or any portion thereof. To the extent any moral rights are not transferable or assignable, you hereby waive and agree never to assert any and all moral rights, or to support, maintain or permit any action based on any moral rights that you may have in or with respect to any User Content you Post to or through the Services.

We also reserve the right to reveal your identity to any third party who reasonably claims   that any User Content posted or uploaded by you to our Services constitutes a violation of their intellectual property rights, or of their right to privacy.

At our exclusive discretion, we or approved third parties may trim, crop, edit, or refuse to publish your work. We reserve the right to remove, disable, block, or delete any complaints or postings you make on our Services if we believe they violate the content standards outlined above.

You control whether your User Content is made publicly available on the Services to all other users of the Services.

We accept no liability in respect of any content submitted by users and or published by us.

Purified News takes reasonable measures to expeditiously remove from our Services any infringing material that we become aware of. It is Purified News’s policy, in appropriate circumstances and at its discretion, to disable or terminate the accounts of users of the Services who repeatedly infringe copyrights or intellectual property rights of others.

While our own staff is always developing and evaluating our own product ideas, we take pride ourselves on paying close attention to the user community’s interests, opinions, comments, and suggestions. If you choose to contribute by sending us any ideas for our products, or services,we will consider it but need you to know that regardless of what your accompanying communication may say, the following terms will apply, so that future misunderstandings can be avoided. Accordingly, by sending Feedback to us, you agree that:

Purified News has no obligation to examine, consider, or implement your Feedback, or to return to you all or part of any Feedback for any reason;

, and we are not under any obligation to keep any Feedback you send confidential or to refrain from using or disclosing it in any way; and

You irrevocably grant us perpetual and unlimited permission to reproduce, distribute, make derivative works of, modify, publicly perform (including on a through-to-the-audience basis), , make available, publicly display, and otherwise use and exploit the Feedback and what is derived from it ,  for any purpose and without restriction, free of charge and without attribution of any kind.

8. Indemnity

You agree to defend, indemnify, and hold harmless Purified News, its parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.

WARRANTIES ARE EXCLUDED

ANY STATUTORY RIGHTS THAT YOU CANNOT CONTRACTUALLY AGREE TO ALTER OR WAIVE AND ARE LEGALLY STILL ENTITLED TO AS A CONSUMER ARE NOT AFFECTED BY THESE TERMS.

THE SERVICES ARE PROVIDED “AS IS,” WITH NO WARRANTY OR REPRESENTATION MADE TO YOU IN THIS REGARD. . WE DO NOT REPRESENT OR WARRANT TO YOU THAT: YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS; YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, Safe, OR ERROR-FREE; ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; AND DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SO

 NO, WARRANTIES, CONDITIONS OR OTHER TERMS APPLY     TO THE SERVICES EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS (INCLUDING ANY IMPLIED TERMS AS TO SATISFACTORY QUALITY, FITNESS FOR PURPOSE, OR CONFORMANCE WITH DESCRIPTION) WE CAN ALTER, SUSPEND, WITHDRAW, OR RESTRICT THE AVAILABILITY OF ALL OR ANY PART OF OUR PLATFORM AT ANY TIME WITHOUT NOTICE FOR BUSINESS AND OPERATIONAL REASONS.

LIABILITY LIMITATION

NEITHER THESE TERMS NOR THE APPLICABLE LAW EXCLUDE OR LIMIT OUR LIABILITY FOR LOSSES THAT ARE NOT EXCLUDED OR LIMITED BY LAW. THIS INCLUDES LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS, OR SUBCONTRACTORS, AS WELL AS FRAUD OR FRAUDULENT MISREPRESENTATION.

SUBJECT TO THE ABOVE PARAGRAPH, WE SHALL NOT BE LIABLE TO YOU FOR: (I) ANY LOSS OF PROFIT (WHETHER DIRECTLY OR INDIRECTLY INCURRED); (II) ANY LOSS OF GOODWILL; (III) ANY LOSS OF OPPORTUNITY; (IV) ANY LOSS OF DATA SUFFERED BY YOU; OR (V) ANY INDIRECT OR CONSEQUENTIAL LOSSES WHICH MAY BE INCLUDED ANY OTHER LOSS WOULD BE LIMITED TO THE AMOUNT YOU HAVE PAID TO PURIFIED NEWS IN THE PREVIOUS 12 MONTHS.

THIS INCLUDES ANY LOSS OR DAMAGE YOU MAY SUFFER AS A RESULT OF: ANY RELIANCE YOU PLACE ON THE COMPLETENESS, ACCURACY, OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICE; ANY CHANGES WE MAY MAKE TO THE SERVICES, OR FOR ANY REASON..

PLEASE NOTE THAT OUR PLATFORM IS ONLY FOR PERSONAL AND PRIVATE USE. WE HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, ECONOMIC LOSS, LOSS OF BUSINESS, LOSS OF GOODWILL OR BUSINESS REPUTATION, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY IF YOU USE OUR PLATFORM FOR OTHER THAN PERSONAL PURPOSES

WE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE THAT YOU MIGHT HAVE AVOIDED BY FOLLOWING OUR ADVICE TO APPLY A FREE UPDATE, OR FOR ANY DAMAGE CAUSED BY YOUR FAILURE TO COMPLY WITH INSTALLATION INSTRUCTIONS OR HAVE IN PLACE THE MINIMUM SYSTEM REQUIREMENTS ADVISED BY US.

ANY TEST-MESSAGING AND DATE CHARGES ASSOCIATED WITH YOUR USE OF OUR SERVICE ARE YOUR RESPONSIBILITY. BEFORE USING THE SERVICE, ASK YOUR SERVICE PROVIDER ABOUT CHARGES YOU MAY BE CONCERNED ABOUT IN RELATION TO OUR SERVICE.

 ANY DISPUTE YOU HAVE WITH ANY THIRD PARTY ARISING OUT OF YOUR USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY COPYRIGHT OWNER, OR OTHER USER, IS DIRECTLY BETWEEN YOU AND SUCH THIRD PARTY.

9. Additional Terms

The term “open source” refers to freely available software. The Platform comes with some open source software. Each piece of open source software has its own set of license terms. Certain open source software is included in the Platform. Each piece of open source software has its own set of licence terms available to review.

The Complete Agreement.

These Terms are the entire legal agreement between you and Purified News and apply to  your use of the Services, superseding any previous agreements between you and Purified News regarding the Services.

There are some hyperlinks.

You can connect to our home page as long as you do so in a way that is fair and lawful, does not hurt or abuse our reputation, and does not suggest any type of association, approval or endorsement on our part where none exists. You are not permitted to connect to our Services through any website other than   your own. The website to which you are linking must adhere to the content requirements outlined   above We reserve the right to revoke linking permission at any time and without prior warning.

There will be no waiver.

Any failure on our part to insist on or implement any clause of these Terms, or any acquiescence on our part in prohibited use, will not be construed as a waiver of that provision or right.

Safety is paramount.

We make no assurances that our Services will be safe or virus-free. To access our Services, you are responsible for configuring your information technology, computer programs, and platform. It is recommended that you use your own virus security programs.

Severability is a term used to describe the ability of these Terms to stand in the event  a court of law with jurisdiction over this matter determines that any clause of these Terms is unconstitutional. In the unlikely event of that occurrence,   that provision will be struck from the Terms without affecting the rest of the Terms, and the remaining provisions will remain valid and enforceable.

WAIVER TO ARBITRATION AND CLASS ACTIONS.

This section includes  an arbitration clause as well as an agreement that all lawsuits will be brought only in the individual’s name (and not as a class action or representative proceeding)  solely in the name of the individual .Please take the time to thoroughly read it . 

Informal Methodology First and foremost. You accept that if you and Purified News have a disagreement, you will first contact Purified News and make a good faith sustained attempt to settle the conflict before resorting to more formal means of resolution, such as legal action.

Arbitration Agreement . After the informal dispute resolution process is completed, any remaining conflict, controversy or allegation  (collectively, “Claim”) relating in any way to your use of Purified News’s services and/or goods, including the Services, or relating in any way to correspondence between you and Purified News or any other user of the Services will be eventually resolved by binding arbitration . This binding arbitration agreement covers both you and Purified News. This arbitration agreement, however, does not (a) control any Claim by Purified News for infringement of its intellectual property or access to the Services that is unauthorized or exceeds the authorization given in these Terms, nor (b) prevent you from using reasonable small claims court procedures. If you are a person, you may opt out of this arbitration agreement by following the protocol outlined below within thirty (30) days of the first date you access or use the Services.

You recognize that you and Purified News are both waiving your right to a jury trial , trial by judge alone, or to join a class action lawsuit. This arbitration clause will remain in effect even though certain Terms are terminated.

You must submit a letter seeking arbitration and explaining your argument to Purified News Inc., Email Address: contact@purified.news after you have completed the informal dispute settlement process.

The Canadian Arbitration Association (CAA) will conduct the arbitration under its rules, including, if you are a consumer, the CAA’s Supplementary Procedures for Consumer-Related Disputes. The CAA’s Supplementary Procedures for Consumer-Related Disputes cannot be used if you are not an individual or have used the Services on behalf of an agency. 

The CAA’s laws control the payment of all filing, administration, and arbitrator fees.

Any conflict relating to the interpretation, applicability, unconscionability, arbitrability, enforceability, or formation of this arbitration agreement will be resolved solely by the arbitrator, not by any federal, state, provincial  or local court, including any argument that any or any part of this arbitration agreement is invalid or voidable. The preceding sentence, however, does not refer to the section below titled “Class Action Waiver.”

Waiver of Class Actions. Any Claim must be made in the individual capacity of the respective party, not as a plaintiff or class member in any ostensibly class, group, delegate, multiple plaintiff, or similar proceeding (“Class Action”). The parties specifically waive their right to file a class action lawsuit in every venue. If the Dispute is open to arbitration, the arbitrator would not be able to merge or consolidate similar claims, conduct a class action, or grant money to someone who is not a party to the arbitration. Any argument that this Class Action Waiver is unenforceable, unconscionable, invalid, or voidable can only be decided by a court of competent jurisdiction, not by an arbitrator. The parties recognize that they have lost their right to sue in court, have their case determined by a judge or jury, or be a member of a class or representative action, and that all claims must be resolved individually, by arbitration.

If this class action exclusion is found to be unenforceable, the entire Arbitration Agreement would be null and void, even if it is otherwise valid. Only the particular party seeking relief and only to the extent appropriate to provide relief warranted by that party’s individual claim can the arbitrator grant declaratory or injunctive relief. If a lawsuit goes to court rather than arbitration for whatever cause, you and Purified News both forfeit your right to a jury trial.

Users of the Services who are California residents and under the age of 18 may contact us at contact@purified.news or to request and obtain removal of User Content they have posted. The subject line of all requests must read “California Removal Request.” Both requests must provide a summary of the User Content to be removed as well as sufficient details to enable us to locate the User Content. California Removal Requests are not accepted by postal mail, telephone, or facsimile. We cannot be held liable for notifications that are not properly labelled or sent, and we may be unable to respond if you do not have sufficient details.

You agree not to export or re-export the Services and/or other information or materials given by Purified News hereunder, directly or indirectly, to any country for which Canada or the United States or any other similar jurisdiction needs an export license or other governmental approval at the time of export without first obtaining such license or approval. The Services may not be exported or re-exported (a) into any Canadian or US embargoed countries or any country designated by the US Government and Canadian Government as a “terrorist supporting” country, or (b) to anyone listed on any US Government and Canadian Government list of prohibited or restricted parties.

You represent and warrant that (a) you are not located in a country that is subject to a Canadian or United States government embargo or has been classified by Canada or the United States government as a “terrorist supporting” country; and (b) you are not on any Canadian United States government list of banned or restricted parties.

The license issued to you hereunder is for a personal, exclusive, non-exclusive, non-transferable right to install the Platform on the Apple device(s) that you own or manage for personal, non-commercial use, subject to the Use Rules set forth in Apple’s App Store Terms of Services.

Apple is not responsible for the Platform or its content, and it is under no obligation to provide any maintenance or support services in connection with it.

You can notify Apple in the event that the Platform fails to adhere to any applicable warranty, and Apple will refund the Platform’s purchase price, if any, to you. Apple would have no other warranty obligations with respect to the Platform to the degree allowed by applicable law.

Apple is not liable for any claims made by you or a third party relating to the Platform or the ownership or use of the Platform, including, but not limited to, product liability claims, claims that the Platform fails to adhere to any relevant legal or regulatory requirement, and claims arising under consumer protection or related legislation.

If a third party claims that the Platform or the possession and use of the Platform infringes on that third party’s intellectual property rights, Apple will not be liable for the prosecution, defense, resolution, or discharge of the intellectual property infringement lawsuit.

Google

Google and its subsidiaries are third-party beneficiaries of these Terms, and if you accept these Terms’ terms and conditions, Google will have the right (and will be considered to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

The Amazon Appstore is a place where you can download apps.

By downloading the Platform from the Amazon Appstore (or its successors) operated by Amazon Digital Services, Inc. or affiliates (“Amazon”), you expressly acknowledge and agree that: to the extent that any conflict exists between (a) the Amazon Appstore Terms of Use or any other terms that Amazon designates as default end user licence terms for the Amazon Appstore (“Amazon Appstore EULA Terms”), and (b) the Amazon Appstore Terms of Use or any other terms that Amazon designates as default end user licence terms
